Terms and Conditions: Courses

These Terms and Conditions set out the terms on which Moss Pottery Studio Ltd (“Moss”) provides the services and allows a person to become a student of the Studio. These Terms and Conditions apply to all Students of the Studio and to all applications for Courses at the Studio.

Moss Pottery Studio is a trading name of Oliver Stanion.

Please review these Terms and Conditions carefully and make sure that you understand them. If you do not agree to these Terms and Conditions, you must not become a Student of the Studio or apply to become a Student of the Studio. 

In the Terms and Conditions the following definitions apply:

Course” means any timetabled, taught class or set of classes for Students;
Class” means any class or individual period or portion of a Course.
Student” or ”you” means any person who is attending a Course;
Studio” or “Moss” or “we” means Moss Studio - Store at 4C Moss lane Altrincham WA14 1BA

References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender and vice versa. These Terms and Conditions are incorporated into the Student Registration Form.

Orders and our agreement -. All offers of Services appearing on the Website are not a legal offer by us to supply such Courses, but an invitation to you to make an offer to purchase a Course. We are free to accept that offer or to reject it. Once we have processed your order, we will send you an e-mail confirming our agreement.  

On placing an order with us (via our registration form or other method that we notify you about), you will receive a confirmation email or other electronic communication to let you know that we have received your order. Our acceptance of your order brings into existence a legally binding agreement between us. Please ensure you keep this email or other communication as we may need you to refer to it should there be any issues with your order. 

In the unlikely case of an error on the website, we will try to contact you to resolve the issue but we reserve the right to correct any errors and inaccuracies, update any information and/or orders where necessary without prior notice. 

Moss may at any time modify these Terms and Conditions. We will notify you of any changes to these Terms and Conditions either by emailing you and/or by posting a notice at the Studio. By continuing to use the Services after changes to these Terms and Conditions are made and notified to you, you agree to be bound by such changes.

You can review the most current version of our Terms and Conditions at any time by clicking on the “Terms and Conditions” link located at the bottom of the Website. It is your responsibility to ensure that you are familiar with the current Terms and Conditions. You are advised to check the above link on a regular basis.

Minimum Age : You must be at least 16 years of age to attend our Courses.  Any child attending a Course under the age of 16 must be supervised by an adult (over the age of 18) at all times and such adult must have accepted these Terms.  We are not responsible for the supervision of children. Students may be required to confirm their age on booking and may be required to provide evidence of age. We will not accept a booking from any person under the age of 16.

Course information

Fees : Course fees will be paid on acceptance onto a course and prior to the start date of the Course.

 Course fees include the first 3kgs of finished, fired work. Additional work and materials will be charged at the rate of £3 per kg.

Time of Courses : We will endeavour to deliver Courses and Classes at the times and dates specified in the course information or, for individual tuition, at the time of booking.

Courses will be delivered by the teacher(s) specified in the course information unless illness or other unforeseen circumstance causes them to be absent in which case a substitute teacher will be provided. In the event no substitute teacher can be found, an additional session will be provided or, if this is not possible, an appropriate refund made for the session(s) not delivered. Accordingly, we cannot guarantee the delivery of Courses on the dates specified and there may be reasons beyond our reasonable control why Courses cannot be delivered on such dates including illness of the teacher. We will endeavour to keep you informed of any changes or cancellations and you will be refunded relevant Course fees if a Course has to be cancelled and cannot be delivered on an alternative  date.

Students will have access to the Studio’s facilities appropriate to their course content.

Non- Attendance - Non-attendance by any Student of any Classes or Courses will not be refunded or substituted.

In the event a Student cannot attend a Class or part of a Course, they may offer their place to a friend for those sessions or Classes. In such a case the friend would also be considered a Student and subject to these terms and conditions.You will remain liable to pay us the Charges for any purchased Course and shall not otherwise transfer your agreement with us to any other person.

Liability - Moss cannot be held responsible for any loss or liability caused through the misuse of the studio or equipment or Students’ failure to follow our reasonable instructions and guidelines SAVE that nothing in these Terms will exclude our liability for injury or death caused by our negligence or the negligence of our teachers or any other liability that cannot be excluded by law.

Our Rules : Students shall at all times follow (i) our health and safety regulations and requirements and (ii) our rules, policies and procedures made available to you or displayed prominently at our site (“Our Rules”). We may make reasonable changes to Our Rules at any time provided that we give you advance notice of the change.

 Cancellations and Refunds

Refunds will only be given as follows: If we receive a cancellation for a Class or Course of at least 7 days in advance, we will pay a refund of the Course fee minus £5 administration charge. If we receive a cancellation with less than 7 days notification, we will only refund the Course fee in gift vouchers (minus £5 administration charge) if we manage to re-sell the booking, but will not refund if we cannot resell the booking.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.


This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Prices

Our prices are in GBP (£) and are set out in our Workshop menu.

Prices for our future Courses are subject to change from time to time.


Availability of website : We reserve the right at any time to modify or discontinue the website (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the website.

General

If we take no action or let you off any breach of our agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.

We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.

As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights

This agreement is governed by English Law.

We may terminate our agreement with you with immediate effect on notifying you if you are in material breach of Our Rules. You are not entitled to a refund of fees paid in such event.

To the best of your knowledge and belief you undertake to us that your engaging in the activities involved when taking a Course will not be detrimental to your health, safety, comfort, wellbeing or physical condition due to allergies or other health issues. Further, that you will advise us immediately should your circumstances change.

Payment

We accept payment from all major credit and debit cards. Card payments are processed securely through payment portal Stripe.

Payment will be debited from your account when the course is booked. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. In the event of a card refusal, we will not accept the booking.

We will not have any access to your data that is exchanged in connection with the purchase. All personal contact information is held strictly confidential. We guarantee no other persons will have access to any of your personal information or payment details.

Use of Cookies

We use cookies on our website only to ensure the best browsing experience, and allow certain aspects of the website and shop function to run correctly.
